User Generated Content Terms and Conditions

In these terms of use, “we”, “us” or “our” refers to 28TEN Media and its associated agencies, subsidiaries and entities – including but not limited to Have You Seen My Socks, Looking Gifty, and The Gift Wrap Workshop.

The “Content” refers to the image, photo, video, text, graphics or other Content you have published on social media platforms (such as Facebook, Instagram, Twitter, Snapchat, YouTube) or emailed or submitted or uploaded directly to social media platforms affiliated with 28TEN Media and its subsidiaries and entities.

“You” or “Author” refers to the author of the Content.

£5 (five pounds sterling) dicsount voucher
We will on occasion at our request offer a £5 (five pounds sterling) off coupon when we use your submitted content. One £5 (five pounds sterling) coupon will be issued per submission regardless of the number of times your content is posted to our social channels. A coupon will only be issued once we post your content to our social channels. A £5 (five pounds sterling) coupon can be redeemed by the email address connected to the submission only, are vaild for tweleve (12) months from issue, can’t be used in conjuction with any other offer, are non-transferable, cannot be exchanged for cash, and must be used in whole in one (1) transaction. Submission of content via this offer will be subject to the below terms and conditions.

Agreeing to these terms of use
Your submission of Content and/or replying to our request to use your Content with the hashtag #Yes28TEN or by clicking ‘I agree’ or ‘I accept’ is deemed acceptance of these Terms of Use.

The Content selected and used by us will be in accordance with these terms and conditions.

In order to be a selected participating contributor, you must be aged 16 years or over and have access to a valid and genuine email address or Third Party Platform account.

By sending in your Photos, Stories and Content, you are consenting to our use of your Photos, Stories and Content, you:

confirm that the Content is your original creation and not copied from third parties;

acknowledge that your Content may appear on any of our social channels

You grant us and its affiliates a non-exclusive, worldwide, transferable, royalty-free, irrevocable, perpetual right and licence without compensation to use your Content as set out in these terms and conditions.

You confirm that you have all the rights necessary to allow us to use your Content.

You confirm that the creation and use of your Content in any of our social channels complies with all applicable laws and regulations.

You warrant that your Content does not infringe or otherwise violate the copyright, trademark, trade, privacy or other intellectual property or other rights of any third party and that your Content is free from viruses and other malware.

You waive any moral rights you may have in your Content, such as any right you may have to be named as the author of the Content or to protect the integrity of your Content.

You give us your permission for us to redesign, archive, reproduce, disseminate, display, publicly perform and/or replay and make publicly accessible, as well as to cut and edit, adapt and modify your Content or any part of it.

If your Content is corrupted, inappropriate, illegible or otherwise not in accordance with these terms and conditions then we will not accept your Content.

You accept that we may choose not to use your Content or to remove your Content from any 28TEN Media social channel at any time. You agree that you will not receive any payment or other remuneration if we use your Content in any 28TEN Media social channel unless overwise agreed prior to submission.

If you remove any of the Content you released to us from the Third Party Platform it was originally posted on, then it will be removed from the our social channels only where your and our Third Party Platforms are linked, subject to reasonable delays for technical reasons. If your Content is used by us on Third Party Platforms which are not linked and as a result your Content is not automatically removed from our social channels, and you would no longer like your Content to be posted on the relevant 28TEN Media social channels, then please contact Our Customer Service Contact Centre to notify us of your request. Once notified, we will remove your Content within a reasonable timeframe.

To the extent it is permitted by law to do so, we accept no liability for any damage, injury or loss suffered due to our use of your Content.

We will only use personal information supplied by you for the purposes of posting your Content, unless you provide your consent for us to use your personal information for any other agreed purpose.

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws  of the United Kingdom.
